BURGLARY (IN PROGRESS) - WEST YORK INN

On 4/12/13 @ 11:58 P.M. - WYBPD was radio dispatched to respond to the West York Inn, 1400 W. Market St., for a report of a possible burglary in progress. Further information detailed that the suspect had been trying to break in to the rear kitchen area by banging metal objects against the kitchen door.
@ 12:01 A.M. - WYBPD arrived on scene and met with bar matron that reported that she had observed the perpetrator walk around the business and then enter the business (still open) and then sit down at the bar.
After the bar matron positively identified this perpetrator, he was then taken into custody. He was then identified as a highly intoxicated Thomas Linwood CHILDS 3RD, 42 Y.O.A., W/M to be residing within the 1500 block of Hunter Drive, Dover, PA.
After being advised of his rights, CHILDS state to the investigating patrolman that he was only trying to gain entry to the bar and that he claimed to have been an employee many years ago, and that was how he entered the bar back then. Damage to the rear door included the plexi-glass window, window trim, frame and the door knob, all now requiring immediate repair/replacement.
The patrolman conducted a search of CHILDS' person and clothing and recovered an "8-ball" pool ball from within his left pocket. When asked if the pool ball was the taken from the bar, he replied "yes." This was verified with the bar patron and will be returned to the bar. The actions of CHILDS did not rise to the level of burglary.
CHILDS was then transported to Central Booking for processing and to be arraigned of the following criminal charges of;
1) Theft of Movable Property - misdemeanor of the 3rd degree
2) Criminal Mischief - misdemeanor of the 3rd degree
3) Public Drunkenness - summary offense
